Terms of Service

Last updated: September 2026 • Please read carefully before using our services

These Terms of Service (“Terms”) govern your access to and use of the Regopen IP website, platform and related services, as well as services ordered or accepted through commercial offers issued by Regopen IP.

By using our Services or actively accepting an offer for Services, you agree to these Terms.

1. Acceptance of Terms

Welcome to Regopen IP. These Terms govern your access to and use of the Regopen IP website, platform and all related services (collectively, the “Services”) provided by Regopen IP (“Regopen IP,” “we,” “us,” or “our”).

By creating an account, using the Services, submitting a service request or actively accepting an offer from Regopen IP, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use or order the Services.

2. Description of Services

Regopen IP provides a technology platform and related services for trademark renewal, trademark registration, trademark search, trademark monitoring, trademark management and related intellectual property services.

Regopen IP is an independent private service provider and is not a government agency, trademark office or public authority.

Regopen IP is not affiliated with, endorsed by, sponsored by or acting on behalf of WIPO, EUIPO, USPTO, UKIPO or any other national or international intellectual property office or government authority.

Regopen IP is not a law firm and does not itself provide legal advice or legal representation.

Where legal services or representation are required or requested, such services may be provided by independent licensed attorneys or authorized representatives, where applicable. Any attorney-client relationship, where applicable, is established directly between the customer and the relevant independent attorney and not with Regopen IP.

3. Commercial Offers and Mailed Communications

3.1 Voluntary Commercial Offers

Any letter, form, notice, renewal communication or other commercial material sent by Regopen IP to a prospective customer by post, electronically or through another communication channel constitutes a voluntary commercial offer for services provided by Regopen IP, unless expressly stated otherwise.

Such communication is not an invoice, payment demand, official renewal notice or communication from a government authority or intellectual property office.

Receiving an offer from Regopen IP does not create a contractual relationship, payment obligation or other commitment between the recipient and Regopen IP.

3.2 No Obligation to Act

Recipients are under no obligation to respond to, accept or otherwise act upon an offer from Regopen IP.

Recipients remain free to manage their trademarks themselves or to use their existing trademark attorney, representative, agent or other service provider.

There is no requirement to appoint or use Regopen IP.

Recipients may contact their existing representative or another service provider regarding their trademark, registration, renewal or other trademark matter if they prefer.

3.3 No Payment Obligation Before Acceptance

No payment is due solely because a recipient has received an offer, form, letter or other communication from Regopen IP.

A payment obligation arises only after the recipient has actively accepted or ordered the relevant service in accordance with the acceptance procedure stated in the offer or service process.

Applicable Regopen IP service fees and known official fees will be presented as part of the relevant offer or service process, where applicable.

3.4 Acceptance of an Offer

By actively accepting an offer from Regopen IP, the customer requests the services specified in that offer and agrees to be bound by the version of these Terms applicable at the time of acceptance.

The accepted offer, together with these Terms and any service-specific terms presented during the ordering process, forms the basis of the agreement between the customer and Regopen IP.

4. Your Account

To access certain features of the Services, you may need to create an account.

You agree to:

  • Provide accurate, current and complete information when creating and maintaining your account.
  • Maintain the security of your account credentials.
  • Promptly update your information if it changes.
  • Accept responsibility for activities performed through your account where attributable to your use or authorization of the account.

You must notify Regopen IP without unreasonable delay if you become aware of unauthorized access to or use of your account.

Regopen IP reserves the right to suspend or restrict account access where reasonably necessary to protect the customer, Regopen IP, other users or the integrity of the Services.

5. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation.
  • Infringe intellectual property rights or other third-party rights.
  • Submit fraudulent, misleading or knowingly inaccurate information.
  • Interfere with or disrupt the integrity or operation of the platform.
  • Attempt to gain unauthorized access to any part of the Services or related systems.
  • Use automated tools to scrape, crawl or extract data without authorization.
  • Transmit viruses, malware or other harmful code.

Regopen IP may restrict or suspend access to the Services where there are reasonable grounds to believe that these Terms have been materially violated.

6. Trademark Services

6.1 Customer Responsibility

Customers are responsible for providing complete, accurate and up-to-date information required for the requested services, including, where applicable:

  • Trademark names.
  • Application or registration numbers.
  • Ownership information.
  • Contact information.
  • Relevant jurisdictions.
  • Requested documents.
  • Instructions required to perform the requested service.

Customers are also responsible for responding to requests for information, documentation, authorization or payment within the time reasonably required to perform the requested service.

Regopen IP is not responsible for delays, missed deadlines or other consequences resulting from incorrect, incomplete, misleading or outdated information supplied by the customer, to the extent permitted by applicable law.

6.2 No Guarantee of Outcome

Regopen IP does not guarantee the registration, renewal, acceptance, approval or continued validity of any trademark.

Final decisions regarding trademark applications, registrations, renewals and related matters are made by the relevant intellectual property office, trademark office or competent authority.

The outcome of any trademark matter may depend on applicable laws and regulations, existing rights, third-party objections or oppositions, information supplied by the customer and decisions made by the relevant authority.

6.3 Processing Times and Third Parties

Any processing or completion times displayed on the Regopen IP website, platform, offer or other communication are estimates unless expressly stated otherwise.

Regopen IP does not control the processing times, systems, procedures or decisions of WIPO, EUIPO, USPTO, UKIPO or any other intellectual property office, government authority or third-party provider.

Regopen IP is not responsible for delays caused by such third parties or circumstances outside Regopen IP's reasonable control, to the extent permitted by applicable law.

6.4 Trademark Monitoring and Renewal Instructions

Adding, importing, searching for or tracking a trademark through the Regopen IP platform does not by itself constitute an instruction to renew the trademark and does not mean that Regopen IP has accepted responsibility for completing a renewal.

A renewal service begins only after the required renewal instruction, information, authorization and payment, where applicable, have been submitted and the service has been accepted by Regopen IP.

Trademark monitoring, alerts and deadline notifications are provided as management tools and do not by themselves constitute acceptance by Regopen IP of responsibility for filing or completing a trademark renewal.

7. Duration of Accepted Services and Future Renewal Contact

Where a commercial offer is accepted, the agreement relating to the accepted service will remain in effect until the next applicable renewal date for the trademark covered by that service, unless otherwise specified in the relevant offer or terminated in accordance with these Terms.

The agreement does not automatically require the customer to purchase or pay for a subsequent trademark renewal unless such a service has been separately ordered or accepted.

Regopen IP reserves the right to contact the customer before, at or after an upcoming trademark renewal date regarding:

  • Renewal deadlines.
  • Trademark status.
  • Renewal services.
  • Trademark management.
  • Other services relevant to the customer's trademark portfolio.

Any subsequent paid service will be subject to the applicable offer and Terms in effect when that service is accepted.

8. Fees and Payment

Certain Services require payment.

By ordering a paid Service, you agree to:

  • Pay the fees presented before the relevant service is ordered or accepted.
  • Provide valid and authorized payment information.
  • Authorize Regopen IP and its payment providers to process applicable charges.

Government, trademark office and other official fees vary depending on the jurisdiction and service requested.

Regopen IP service fees are separate from government and official trademark office fees unless expressly stated otherwise.

Applicable Regopen IP service fees and known official fees will be presented during the relevant service process before payment or submission, where applicable.

Any price estimate is based on the information available at the time of calculation and may change if the customer changes the requested service, jurisdictions, trademark classes or other relevant information, or if official fees or applicable requirements change.

9. Refund Policy

Refund eligibility depends on the status of the relevant service.

Before Filing or Submission

Where work has not commenced and no filing, submission or third-party cost has been incurred, a refund may be available subject to the circumstances of the order.

After Filing or Submission

Government, trademark office and other third-party fees may be non-refundable once paid, submitted or incurred.

Regopen IP service fees may also become non-refundable once substantial work has been performed or the relevant service has been submitted or completed.

Completed Services

No refund will normally be issued for services that have been fully performed, except where required by applicable law.

Nothing in this Refund Policy limits any mandatory rights that cannot lawfully be excluded or restricted.

10. Third-Party Service Providers and Information Sharing

The customer acknowledges that Regopen IP may need to disclose, transmit or otherwise make information available to third parties where reasonably necessary to provide, administer or complete the requested Services.

Such third parties may include:

  • Independent licensed attorneys.
  • Authorized trademark representatives.
  • Trademark and intellectual property service providers.
  • Technology and infrastructure providers.
  • Payment service providers.
  • WIPO, EUIPO, USPTO, UKIPO and other relevant intellectual property offices or competent authorities.

Regopen IP will only share information where reasonably necessary for the relevant purpose or where otherwise permitted or required by applicable law.

Personal data will be processed in accordance with the Regopen IP Privacy Policy and applicable data protection requirements.

11. Assignment and Transfer

Regopen IP may assign or transfer its rights and obligations under these Terms to another legal entity in connection with a reorganization, restructuring, merger, acquisition, transfer of business or similar corporate transaction, subject to applicable law.

Where required by applicable law, affected customers will be informed of such a transfer and any applicable rights available to them.

The customer may not assign or transfer an agreement with Regopen IP without prior written consent where such consent is permitted to be required by applicable law.

12. Intellectual Property

All content, trademarks, logos, software, designs, text and other intellectual property displayed on or forming part of the Regopen IP website and platform are owned by Regopen IP or its licensors, as applicable.

You may not copy, reproduce, distribute, modify, create derivative works from or commercially exploit such material without prior written consent, except where permitted by applicable law.

Third-party trademarks, logos, names and other intellectual property remain the property of their respective owners.

The display of information concerning a trademark, trademark office or third party does not imply affiliation with or endorsement by that party.

13. General Information and No Legal Advice

Information made available through the Regopen IP website, platform, Insights, Industry Updates or other informational resources is provided for general informational purposes only and does not by itself constitute legal advice.

Trademark laws, procedures, requirements, deadlines and fees vary between jurisdictions and may change over time.

General information provided through Regopen IP should not be relied upon as a substitute for legal advice relating to a customer's specific circumstances.

Where specific legal advice or legal representation is required, such services may be provided separately by an independent licensed attorney or authorized representative, where applicable.

14. Disclaimer of Warranties

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Regopen IP does not warrant that the website or platform will always be uninterrupted, error-free or available at all times.

Regopen IP does not guarantee any particular decision or outcome from a trademark office, intellectual property office, government authority or other third party.

Nothing in these Terms excludes any warranty, guarantee or other right that cannot lawfully be excluded under applicable law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Regopen IP and its officers, directors, employees and agents will not be liable for indirect, incidental, special, consequential or punitive damages arising out of or relating to the use of the Services.

Regopen IP is not responsible for decisions made by intellectual property offices, government authorities or other independent third parties.

Regopen IP is not responsible for loss or damage resulting from inaccurate, incomplete or outdated information supplied by the customer, or from a customer's failure to provide required instructions, authorization, documentation or payment within the necessary timeframe, to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.

16. Changes to the Services and Terms

Regopen IP may update the Services and these Terms from time to time.

The version of the Terms applicable to a specific accepted offer or service will generally be the version in effect when that offer or service is accepted, unless applicable law or the agreement requires otherwise.

Material changes affecting existing customers will be communicated where required by applicable law.

The current version of these Terms will be made available on the Regopen IP website.

17. Termination and Suspension

Customers may stop using the platform at any time, subject to any obligations relating to Services already ordered or accepted.

Regopen IP may suspend or terminate access to the Services where reasonably necessary due to:

  • A material breach of these Terms.
  • Fraudulent or unlawful activity.
  • Non-payment of amounts properly due.
  • Security risks.
  • Misuse of the platform.
  • Legal or regulatory requirements.

Termination of account access does not automatically cancel or reverse a trademark filing, renewal, official fee or other service that has already been submitted or performed.

18. Complaints, Disputes and Legal Contact

Questions, complaints, disputes, claims or other legal matters relating to Regopen IP or the Services should be submitted to:

Regopen IP
